Well, they, "The **** Group", for those not in the know lost big time. Behringer is pursuing a $250,000 lawsuit against Dave Smith Instruments, one of Dave Smith Instruments' employees and 20 anonymous forum users. CDM reports that the suit, filed in San Francisco County Superior Court on June 9th, seeks damages for libel per se, libel per quod and product disparagement. It's based on comments made in a thread on the Gearslutz forum, wherein Dave Smith Instruments engineer Tony Karavidas and 20 anonymous forum users were alleged to have made "false, defamatory, and libelous" statements about Behringer products. One of the comments referred to Behringer's 6-in-1 cable tester as a "blatant copy, except for the paint" of the Ebtech 6-in-1 cable tester, pictured below. image urlThe court rejected the suit, ruling that "all of Music Group's (Behringer's parent company) claims against it arise from activity protected by the anti-SLAPP statute, because all of the claims are based on statements that were made in a public forum on an issue of public interest." The anti-SLAPP statute seeks to stop lawsuits designed to censor critics from going to trial. Dave Smith Instruments is now seeking to recoup financial costs. News came to light last week that Behringer also threatened to sue Chinese tech blog Midifan. As of yet, no law suit has been opened.

Seems like the purple site scrubbed/deleted the threads about this even happening.Glad the court got that one right. Gearbuts on the otherhand has lost the last drop of respect I had for them, deleting all that is blatant censorship- folks are talking about it over on Reddit too. I've lost all faith in that site, and for a FACT will never buy a behringer product EVER.

Well, I have to admit...I don't want a lawsuit here - I don't have the money to spend even if I were assured of winning. So, anything that might result in a lawsuit will get deleted here too.

What does that mean? Can we talk about a boycott? Can we note when a company's product looks eerily similar to another company's product? Can we fundraise to pay for someone to defend a lawsuit? Sounds like a pretty tricky line to draw.

Agreed, I think you might need to add something like this to the rules; While the goal here is an honest open intelligent entertaining discussion of music, production, and pro audio, this is not a democracy. It is in fact an enterprise wholly owned by John Kennedy who as the owner assumes all risks and therefore retains the right to edit and censor anything he sees fit at his discretion. If you don’t like it I will gladly consult on how to set up your own forum for a modest fee.

What does that mean? Can we talk about a boycott? Can we note when a company's product looks eerily similar to another company's product? Can we fundraise to pay for someone to defend a lawsuit? Sounds like a pretty tricky line to draw. My hunch is this, if he receives a cease and dissist letter for some reason from somebody’s lawyer John will comply. Not because he’s a coward or some agenda but first rule of life is survival, and lawyers ain’t cheap! I’ll put it this way Uli’s got more money than brains and Johns got more brains than money, he would like to keep that money in his bank acct not his lawyers.

I haven’t run into anything like that, but if someone sent me a cease and desist, I’d most likely cease and desist. There’s a donate now button at the top - which sans three people this year - hasn’t been used. It annoys me to some extent that people complain about their “freedoms”. You mean the ones I pay for? Ok. Rant over.
