looks like GS 86'd Les's thread on the highend forum. Yes, and I got this private message from Jules: It's part of our terms and rules that we disallow legal dispute stuff top spill over into the forums. They are going to have to sort it out between themselves. The may be better suited to your own Facebook pages - not ours - thanks Thats just against the spirit of what these Forums are all about. Really dancing on the corporate pole of his advertisers.

Kind've interesting that you can still find the API vs. JVC thread on GS. Started by APIsez. I guess the rules only apply to some.

So the GS thread has already been shut down??? Yep . there was two threads , both deleted . The info was exposing API for what they are and it was bad publicity .

I would say this - let's be cautious. Regardless of who's side you're on in this debacle, you don't want to do anything that could give the other side ammo. Let's leave the lawyering to lawyers. joelhamilton is a lawyer, but I doubt he would touch this with a ten foot poll in a public forum. Let's vote with our wallets and spread the word. The complaint is public, but I've been told it wouldn't be a good idea to post it...

Is it true the complaint allegedly includes that api didn't know of capi until Jan this year.
Man, that comes across as very dishonest if it is proven true.

This is what I get when I try to access the thread on the purple site:
"Spiritworks, you do not have permission to access this page. This could be due to one of several reasons: 1.Your user account may not have sufficient privileges to access this page. Are you trying to edit someone else's post, access administrative features or some other privileged system? 2.If you are trying to post, the administrator may have disabled your account, or it may be awaiting activation."

I am by no means taking up for Jules, but it's in his rules. Just fits his agenda this time.

Because I love me some double standards www.gearslutz.com/board/product-alerts-older-than-2-months/415522-api-sued-jvc-over-arsenal-audio-product-name.html?highlight=arsenalAPI Sued by JVC over Arsenal Audio product name Automated Processes, Inc. (API) has received a formal complaint from electronics giant JVC Americas Corporation against API’s use of the word “Arsenal” in reference to API’s recently introduced brand of pro audio equipment. Arsenal Audio by API products include a microphone preamp and two versions of a four band audio equalizer manufactured for use by professional recording artists and engineers. JVC Americas Corp. is the registered owner of the word ‘Arsenal’ in association with products for car audio equipment. The complaint centers around the claim that API willfully infringed upon JVC’s trademark with the “clear unmistakable intent and effect of causing confusion, mistake and deception among customers”. JVC contends that API’s Arsenal Audio products would be confused with JVC’s line of car audio equipment, and that API is ‘cybersquatting’ by registering the domain name ArsenalAudio.com for the promotion of the Arsenal Audio brand. JVC is demanding unrestricted access to the domain name. “We were completely blindsided, and are unaware that JVC has ever manufactured any piece of pro audio equipment” said Larry Droppa, API President. “And we can verify with assurance that API has never and likely will never manufacture a piece of audio equipment that installs in an automobile. Given the name “Arsenal Audio by API”, I’m very confident that the buyer of a piece of Arsenal Audio equipment by API is extremely familiar with who the manufacturer is.” API explored a number of options to negotiate a settlement with JVC Americas Corp, but all proposal attempts were rejected by JVC. it might just be easier to change the name. I really don't think it would hurt him. And if he's moving to Nashville, it could be a fresh start for the company. I had mentioned at one point if he moved to Nashville he should change the name to CAPN - I think it's kind of a cooler acronym anyway. Then he could put out a compressor/color box and call it the "Crunch". I'd have some CAPN Crunch in my rack for sure! We're way ahead of ourselves, but I wouldn't name a gear line after Nashville unless it had some sort of vintage C&W lineage. Unless you want people to think that your pre will make them sound like Brad Paisley.

We have a saying here in Germany (translated as near as possible...): "Who's bread i eat, who's song i sing."
Double standards, driven by advertising. Just what was to be expected...

Hey guys - we have to be VERY careful in what we say. And I'm speaking for myself here too. This isn't just internet banter, it's a lawsuit. So, if you don't mind policing yourself and editing your comments to include less demonstrative language I would appreciate it. Maybe more "allegedly's" and "It is my understanding's"...While I absolutely don't agree with API's position, I also am not armed with all the facts of their patents and Trademarks, so it is advisable to just support Jeff and not try to litigate the matter myself. I would hate to say anything that could hurt his cause. You can google the lawsuit and draw your own conclusions.

Well said. Personal opinions about justice, fairness and moral right are categorically something very different from actual law. Everywhere, btw...

agreed, i get fired up about protecting my boys! As I understand, Jeff has been a gear godsend to me, and I allegedly cannot say that about modern API I'm sure Jeffs gotten wind of this thread, so if you're reading, sorry about all this happening bud, you rule!

The problem is undoubtedly stuff being marketed as "classic API" without permission. If API fails to defend their trademark, they lose it to the public domain. That's just how trademark law works. It's no different than the service mark for a band.
