Somebody correct me if I'm wrong, but Jeff could build exact clones of the 3232 and there shouldn't be any problem, right? Doesn't the patent only last 20 years? So - worst comes to worst, he has to change the name and the logo...but they're suing him for damages, right?

the whole thing's a joke, they already have seemed to have perjured themselves in WRITING in the complaint, patents only last 17.5 years, an op amp symbol and an arrow are not the same things, they don't own the knobs, colors and numbers are not trademarkable/ or patentable, the Jury has no power to create their own rules, attorneys cannot submit known untruths or feelings as evidence, a competent attorney would object, motion for striking, and have so much of what they're claiming dismissed as the judge would HAVE no choice but to sustain it unless he wanted to be seen as a laughing stock! None of Jeffs designs are directly comparable to what API makes.

It isn't about that It is an image on a website as a background of a product that is in fact an API product, this image is being used to sell a Product that is similar in nature and the Console Image plus the CAPI/ API thing and the Arrow / Double Diode logo could if presented right be taken by a non Audio person as a an effort to imply an Endorsement or relationship ! Even when you can poke holes in all the points you still have to look at the whole picture! It sucks ! Honestly I think Larry sees things this way because this what he would do! Biggest problems might be Idiots on GS and Analog Services because this points to the fact that even if one takes Jeff efforts as trying to show a difference people are confused and well not always all that bright! |

Don't think pulling stuff will help. I think Larry sees Jeff as low lying fruit, and if this works others will see him pull the same thing ! Of course he forgets many modular consoles pre date API, even API 300 and 500 frames were not API designs they were generic card frame formats ! He going to sue some companies that hold the patens for those? Oh yeah Larry go sue Aphex for their lunchbox it pre dates yours! |

I just used my Electro-Voice 312 microphone clips. They work much better than the API 312.

it might just be easier to change the name. I really don't think it would hurt him. And if he's moving to Nashville, it could be a fresh start for the company. I had mentioned at one point if he moved to Nashville he should change the name to CAPN - I think it's kind of a cooler acronym anyway. Then he could put out a compressor/color box and call it the "Crunch". I'd have some CAPN Crunch in my rack for sure! |
